No Fault Divorces
Since 2010, couples in New York State may now file for a “no-fault divorce.” This means that you no longer need to cite specific grounds as a basis for your divorce petition.
However, you still may file if the other party has not agreed, or file based upon one of the grounds allowable for a divorce in New York State, which include cruel and inhumane treatment, abandonment, adultery, an irretrievable breakdown for at least six months, and imprisonment. You may also file for a legal separation in lieu of a divorce proceeding until both parties decide to pursue divorce proceedings.
Same-Sex Marriage and Dissolutions
Since same-sex couples now enjoy all the benefits and legal protections that come with marriage, they also can avail themselves to all the legal rights and protections that current divorce law allows. We can help you dissolve your marriage using these remedies.
Safeguard Your Assets
When we file a divorce petition we will, at the same time, ask for temporary court orders, such as temporary spousal support or child support, temporary child custody. Other matters include a determination of who will keep the home and how the bills will be paid during the period from the filing date until your divorce is final. We’ll also protect your assets by asking that the court order your former partner not to transfer monies from your account, sell assets or run up credit card debt during this period.
New York is an "equitable distribution" state. When you get married, both parties will have rights to most types of assets accumulated during the marriage. When a marriage ends, however, how those assets are divided depends on the length of the marriage and how allocating each asset would be the most fair or equitable for each party.
It’s not uncommon to become frustrated at how difficult other assets are to divide. In some cases home refinancing may be required. Our family law attorneys can help you get an accurate assessment of fair market value.
